Terms

Terms of business

The work we do for you is governed by these terms and any variation agreed in writing. Please keep them for reference.

In these terms, "we", "us" and "our" mean Wellington Property Services Limited (company no. 17451841). "You" means the landlord, letting agent or property manager who instructs us.

No director, member of staff or subcontractor has any personal legal liability for their work, whether in contract or negligence. That an individual signs a report or letter in their own name does not mean they are assuming personal liability for it.

Services

We provide inventory, check-in, check-out and mid-term inspection reports, and stand-alone schedules of condition.

Inventories, check-ins and check-outs include utility meter readings, except where a meter cannot be accessed or access was not arranged before the appointment.

We are happy to compile an inventory with the landlord or the tenant present. We report the condition of the property only as it is seen at the time of the visit, so any cleaning or maintenance should be finished before the appointment.

We do not inspect loft or attic spaces. Cellars can be inspected if arranged at the time of booking.

Bookings

Book by phone on 07541 345053 or by email to hello@wellington-ps.co.uk.

We prefer at least 24 hours' notice. We will do our best to accommodate bookings made at shorter notice, but it is not always possible.

Appointments are available Monday to Friday, 9am to 6pm. Saturday, Sunday and bank holiday appointments are by arrangement and may carry an additional charge of £30.

Cancellations

Bookings cancelled with more than 24 hours' notice carry no charge. Same-day cancellations are charged at 50% of the fee.

If a tenant or landlord fails to attend, or our clerk cannot gain access to the property for any reason, the visit is treated as aborted and the full fee is charged. If our clerk has waited for more than 15 minutes, they may treat the visit as aborted.

Payment and invoicing

We invoice weekly. Payment is due within 7 days; the due date is shown on each invoice. Work booked by a letting agent is invoiced to the agent, not to the landlord. Private landlords are asked to pay 50% of the fee when booking.

If an invoice is not paid on time we may charge interest daily at the rate payable on judgment debts, recover the costs of collecting the overdue amount, decline further work until we are paid in full, and withhold reports until we are paid in full.

Payment can be made by bank transfer. Bank details are on each invoice.

If we are asked to attend court or a hearing as a witness, our charge is £30 plus VAT per hour per person, including travel time, plus travel and reasonable expenses.

VAT

VAT, where applicable, is payable on fees and expenses at the current rate.

Our duty

We act on your reasonable instructions, subject to our professional duties as inventory providers. Our relationship is with you and we owe a duty of care to you alone. No one else may rely on our reports or on these terms without our prior written agreement.

Our liability

If we make a mistake – a breach of our duties to you – and are liable to compensate you, our liability is limited as follows:

  • It is Wellington Property Services Limited that is liable, not an individual director, member of staff or subcontractor. You agree not to bring a claim against an individual, except in the case of fraud.
  • Our maximum liability for any mistake, except fraud, is £1 million. This overall limit applies whether the mistake affects one piece of work or several, so long as it is the same or a similar mistake, and more than one mistake in the same matter is treated as one.
  • We are not liable to the extent that a mistake results from something you do or fail to do, such as giving us wrong information or not giving us information when we ask for it.
  • If others are also responsible for your loss, our liability is limited to our fair share, whether or not you can recover the rest from them.

These limits apply to the extent the law permits. We cannot, for example, exclude liability for death or personal injury caused by our negligence. If you think we have made a mistake, we have no liability unless you tell us in writing within five working days of becoming aware of it and begin any legal proceedings within three months of that notice.

Confidentiality

We keep information about you and your business confidential and do not disclose it without your consent, except: in the proper handling of your work; on a confidential basis to auditors making random checks of files; to our professional indemnity insurers; where required by law or a court order; and on a confidential basis to providers of administrative services. If we are compelled to disclose information, or you ask us to object to disclosure, we may charge for the work involved.

Email

We routinely communicate by email. We use normal levels of security, but you accept that email may not be secure.

Complaints

We investigate every complaint promptly and thoroughly. Please send full details to hello@wellington-ps.co.uk.

Turnaround

Check-out reports are issued within two working days of the visit, and all other reports within three working days.

Duty of care notes

Furniture and furnishings

The Furniture and Furnishings (Fire) (Safety) Regulations 1988, as amended, require soft furnishings – anything padded, foam, fibre or feather filled, including sofas, armchairs, beds, mattresses, covered bed bases, pillows, cushions, padded stools and dining chairs – to carry a permanent compliance label. Swing labels do not count. Beds, bed bases and mattresses should carry a British Standard label (BS 5852 or BS 7177).

Our reports state whether the relevant label was seen. Where it was not, the report says "no label seen". A label being present does not mean we have verified that the item complies. It is an offence for a landlord or agent to leave non-compliant items in a let property.

Gas

The Gas Safety (Installation and Use) Regulations 1998 require all gas appliances to be checked annually by a registered engineer and a certificate given to the tenant. Where we have seen the certificate, its date is recorded in the report.

Electrical equipment

Electrical appliances in a let property must be safe, and plugs must be sleeved and correctly fused. Our clerks are not electricians and do not test electrical items; reports carry a note to that effect.

Smoke and carbon monoxide alarms

We test alarms using the test button only and record the result. This is not an electrical inspection and does not confirm that an alarm is correctly sited or within its service life.

Security

When we leave a property we make sure it is secure, with all windows and doors shut and locked.
